What does a rental dispute with pro deo cost? Make a complete cost overview
5 minute read
Human legal and language review remains pending.
Pro deo concerns subsidy for legal assistance. It is not a general insurance against every bill that may arise in a rental dispute. By setting costs in separate items in advance, you can better assess a quote and a legal aid decision.

- What costs are associated with the lawyer?
- What costs fall outside that contribution?
- The risk of the other party's costs

- Set a limit for costs incurred on your behalf
- Compare a settlement with the further cost risk
1. What costs are associated with the lawyer?
Ask at the first contact if the office works with legal aid grants, what the application involves and what personal contribution may apply. Also, have it recorded what happens if the Raad rejects. An announced fixed price for an intake is not an obvious price for the entire rental case.
Check the decision alongside the assignment: is it the same dispute and the same activities? Ask with a bill what amount is the personal contribution and what other items are charged. The Raad explains the personal contribution. An unclear invoice is not solved by adding amounts from different schemes together.
2. What costs fall outside that contribution?
Depending on the procedure, court fees, bailiff costs, extracts and expert costs may arise. The Huurcommissie has its own rules for fees or a fixed compensation. Ask per item who gives the order, who invoices and whether a reduction, exemption or other compensation can be investigated.
A structural report that you commission yourself is not automatically paid afterwards. First discuss what research question is needed and whether the chosen report is useful for that. The official explanation of other costs clarifies why a legal aid grant and a complete cost estimate are needed alongside each other.
3. The risk of the other party's costs
In a judicial procedure, a cost order may follow. The judge determines which costs are eligible; this is not automatically equal to the actual lawyer's bill. A personal legal aid grant does not generally eliminate the risk of a cost order.
Therefore, discuss your financial risk in case of loss, partial success and a settlement alongside your legal chances. Ask in a settlement whether each party bears their own costs or if a separate agreement is made. Also, record what happens with already incurred bailiff and research costs. See Case law on costs in rental disputes.
4. Calculate with confirmed, estimated and unknown
Make an overview with three columns: confirmed amount, estimate and still unknown. A legal aid decision can confirm a personal contribution, while an expert investigation is still just a proposal. A total that treats both as certain gives a misleading picture of your affordability.
Illustrative budgeting method: if €400 in confirmed items is fixed and €150 research is estimated, then €550 is a provisional scenario. It is not a statutory rate and not a maximum. Note separately that a cost order or additional procedure has not yet been budgeted. Use the worksheet to take the missing questions to the office.
5. If paying the personal contribution is not possible
Contact early about the payment arrangement. In case of an income drop, peiljaarverlegging may be relevant. Sometimes local support can be investigated, but conditions vary and the municipality decides on any provision. Do not assume automatic reimbursement afterwards.
Ask what documents an assessment needs and what action cannot wait. A payment question allows the rental terms and process dates to continue. Read income decreased during your rental dispute for the separation between current payment capacity and the fiscal assessment year.
6. Check the bill also upon completion
Request a clear final statement with the agreed assignment, received advances and the processing of any cost reimbursements. If you receive money from the case, the financing may still raise questions afterwards. Have the lawyer explain whether a result assessment is relevant and what information is provided for that.
Keep invoices, payment proofs, decisions and the judgment together. A higher amount than expected may result from an additional assignment, a changed subsidy judgment or an error. The correct response starts with determining the reason, not with a general conclusion that pro deo should always have been free.
7. Set a limit for costs incurred on your behalf
Ask in advance which expenses the lawyer or advisor can incur without new consultation. Agree, for example, when an expert, additional procedure or more extensive investigation is first discussed with you. A cost ceiling must specify which activities it covers and which items are excluded.
If the case changes, request a new estimate with explanation. This may be necessary if a simple negotiation becomes a procedure or if a counterclaim is filed. Record which costs have already been incurred and which are still avoidable. This keeps the question of whether you continue concretely discussable.
8. Compare a settlement with the further cost risk
An offered amount to settle the dispute should be considered alongside the substantive rights, conditions, and further costs. Ask if the offer also includes legal costs and expenses already incurred. Check if final discharge or a departure agreement has a broader meaning than just the disputed bill.
A cost saving does not automatically make a settlement wise. Have the full text and the feasibility of alternatives assessed. Use the worksheet to separately note which amount is fixed, which rights are waived, and what financial risk remains without agreement.
Different questions, different confirmations
| Question | What do you verify? | What is not yet a confirmation? |
|---|---|---|
| Legal step | Document, competent office and deadline | A general contact request |
| Financing | Assignment, application and decision | A separate income test |
| Costs | Own contribution and other items | An unspecified total |
| Execution | Who acts and who provides feedback? | Only the name of an office |
Extra exercise: turn a missing answer into a question
Illustrative exercise: you know an office will call you back, but not whether it has already performed a necessary action for you. Then note the concrete question: have you accepted the assignment and who monitors the date in my letter? Also ask for confirmation for the financing and costs. A completed worksheet alone does not give that assignment.
Prepare for the conversation
Only fill in short notes. Do not record BSN, children's names, medical information, or other sensitive data. This worksheet helps you organise questions; it does not calculate entitlement to subsidy.
Your notes remain on this page in your browser. This worksheet sends and saves nothing. Download only on a device where you want that; you decide with whom you share the file.
What personal contribution or other item has already been established?
What costs are only estimated and by whom?
For example, expert, additional procedure or legal costs.
When do you discuss changes with the office?
Take this to your conversation
- Assignment and legal aid decision side by side.
- A list with personal contribution, procedure costs and third-party costs.
- An estimate of the financial risk with the possible outcomes.
- Agreements on extra work, payment and the final statement.
This is general information about Dutch law. The worksheet is not an application, objection, calculation of entitlement to subsidy, or confirmation of an assignment. Check deadlines in your own documents.

Frequently asked questions
Are expert costs always paid with pro deo?
No. Discuss necessity, permission, assignment and compensation before incurring costs.
Do I get all costs back if I win?
That is not certain. The judgment, applicable cost rules and any agreements determine what is reimbursed.
May I use the budget sheet as a quote?
No. It is a preparation. Only the office or the other involved authority can confirm the applicable amounts and agreements.
