Your landlord sells the home: what changes?
5 minute read
Sale usually changes the landlord rather than automatically ending the tenancy. Clarify transfer, payments and viewing access. Treat a request to leave or sign another agreement as a separate legal issue. A sale plan differs from valid termination of protected rent. Keep existing terms and correspondence so the new contact can trace outstanding repairs, deposit and payment arrangements.

Understand continuity after sale
Ordinary residential rent does not end solely because the property is sold. The buyer generally becomes landlord. The official termination guidance explains this starting point. Keep the existing agreement and amendments. New letterhead or payment details do not establish a completely new rental regime. Identify the legal transfer and terms actually agreed rather than assuming the paperwork restarts everything.
Request clear transfer confirmation
Establish responsibility for rent, repairs and accounts from a specific date. Retain messages from both parties and verify bank changes through a known contact before paying. A sales agent is not automatically the new landlord. Identify who represents whom so notices reach the proper party and payments do not disappear between administrations without a usable receipt or explanation.
Assess any proposed replacement agreement
Ask why another agreement is needed and compare every change: duration, basic rent, indexation, deposit and waiver. Administration can be updated without blindly accepting less favourable terms. Assess a new temporary document against existing protection before signing. The agreement-check guide helps record old and new wording, including apparently small changes to commencement and termination provisions.
Check a new payment demand
Transfer does not automatically permit any new price. Existing contractual and statutory increase rules remain relevant. Request the precise basis and calculation. A basic-rent increase, service advance and replacement tenancy are separate questions. Preserve earlier payments and notices so an agent’s new system can be reconciled with the continuing agreement rather than becoming an unsupported new starting point.
Arrange valuations and viewings practically
Discuss reasonable times, advance warning and supervision, considering applicable cooperation duties. Possession of a key does not grant unrestricted unannounced entry. The good landlordship rules address access. Record arrangements and distinguish them from consent to leave. Allowing a valuation visit is not itself agreement to terminate the tenancy or surrender protection.
Check specific exceptions individually
The Rijksoverheid identifies a special sale ground with strict conditions involving a particular cohabitation situation and contractual terms. Leegstandwet letting can also differ. Neither assume sale can never support termination nor accept any generic sale clause. Ask which statutory arrangement applies and assess every condition and required procedure.
If the buyer wants personal occupation
That requires a separate urgent own-use assessment, including potential additional conditions for a new owner. An understandable housing wish does not authorise immediate eviction. Record when ownership and landlord changes were notified. A mortgage condition or sale arrangement between buyer and seller does not independently replace tenancy-law requirements or automatically end your contract.
Read a voluntary departure offer carefully
Compensation or moving assistance may be offered to obtain vacant possession. Establish existing rights before assessing the offer. Check the end date, payment timing, deposit, expenses and final discharge. Use the termination-agreement guide. An attractive sum may be payable only after a departure you cannot organise. Make the obligations specific and reciprocal rather than relying on a headline amount.
Maintain the repair and deposit file after transfer
Continue reporting faults and retain earlier notices. Ask who follows up unresolved work and how the deposit is recorded; do not pay it again without a basis. For departure disputes follow security of tenure and respond to legal documents. The Juridisch Loket discusses sale and termination. Your file connects old terms with the new contact.

Transfer information or a termination action?
| Message | What to check | Does not automatically mean |
|---|---|---|
| New owner identified | Transfer date and contact | A new tenancy agreement |
| New bank account | Source and effective date | A new rent |
| Viewing requested | Timing, access and supervision | Consent to departure |
| Departure payment offered | Complete settlement | A valid statutory ground |
Example: a new agent sends a higher invoice
After sale, an agent invoices a higher monthly total. The tenant compares the existing contract, latest increase notice and earlier breakdown. They ask whether the difference concerns basic rent, energy or an administrative error.
Transfer is not mistaken for an unrestricted new price offer. The answer may reveal missing information or an increase requiring assessment. Compare components before accepting the amount, objecting or signing a replacement agreement.

Frequently asked questions
Can a sales agent promise I may remain?
Establish whom they represent and obtain confirmation from the authorised landlord. Keep promises while assessing the existing contract and law too. A sales conversation does not replace a complete legal assessment.
Must I always attend viewings?
Agree access, supervision and notice. Reasonableness and duties depend on circumstances. Ownership does not allow entry whenever desired, while cooperation obligations can matter.
Can the deposit disappear through sale?
Ask how the position was transferred and retain original payment evidence. Internal settlement between owners does not automatically remove your claim. Assess the correct party if repayment is disputed later.
Is every sale clause valid?
No. Wording must fit a statutory arrangement and its conditions. A statement that sale requires departure is not a complete assessment. Consider date, clause and facts together.
