Is my rent reasonable? Start with the points.
5 minute read
Reasonable rent depends on more than prices in comparable advertisements. The woningwaarderingsstelsel awards points for accommodation quality. Their legal significance then depends on your agreement date, initial rent and rental sector. This guide helps you prepare a calculation that can be checked and identify the appropriate procedure. An online points result does not automatically change the amount you must pay.

1. Separate the monthly payment first
Find basic rent in the agreement and separate advances for energy, services and other items. Comparing a total payment with a maximum basic rent gives a misleading result. Also check whether the original price had a different composition from today’s payment.
If no identifiable basic rent was agreed, investigate all-in rent first. One combined bank transfer does not establish an all-in agreement. The agreed price structure matters rather than just the payment method.
2. Select the home or room check
Self-contained homes and rooms use different valuation systems. Describe which essential facilities are private and which are shared. A private lock, separate floor or studio advertisement does not decide classification alone. Select the correct official Huurprijscheck.
The wording matters when distinguishing joint tenancy from separate room agreements. Three housemates signing one whole-home agreement are not automatically three separate room tenants. Resolve classification before entering measurements into an unsuitable calculation.
3. Make measurements reproducible
Prepare a simple plan with dimensions per room. Record where measurements were taken, including sloping roofs, storage areas and outside space. Follow the official instructions. Advertised floor area or the total area of floorboards is not necessarily the valuation area.
Photograph unusual features. Explaining a disputed small space can be more useful than a rounded overall figure. Distinguish verified measurements from estimates requiring further checking. Apparent precision does not make uncertain information reliable.
4. Check energy label, WOZ value and facilities
Gather the energy label and applicable WOZ property information for the relevant assessment. Record kitchen and bathroom facilities accurately. Not every purchased or tenant-installed item is valued identically. Check any special monument or new-build rules invoked.
Request the landlord’s points calculation and compare each input. New agreements from 1 January 2025 require a written calculation. A points total without underlying entries does not explain why your assessments differ.
5. Establish the contractual regime
The Huurcommissie explains the Wet betaalbare huur. Protection operates differently for agreements before 1 July 2024 and later agreements. Initial basic rent matters too. A current price in a particular band does not automatically make an older agreement mid-rent.
Transitional provisions may affect older liberalised contracts for low-points homes. Investigate the relevant route rather than simply applying the new points boundary to an old agreement. Consult social housing, mid-rent housing or the unregulated sector.
6. Choose initial assessment or later reduction
An initial rent assessment considers the agreed rent and accommodation at commencement. Its deadline and effective-date consequences differ from a later points-based reduction proposal. Waiting for an annual increase can therefore unnecessarily lose an available route.
The Huurcommissie describes the points procedures. State whether you want the initial price assessed or future rent adjusted. Then establish the correct form, required proposal and application deadline.
7. Make a proposal the landlord can verify
Specify current and proposed basic rent, calculated points and intended commencement date. Include the calculation and key evidence. Where appropriate, use the official model and check procedural conditions. A later reduction cannot simply be assigned a retrospective date of your choosing.
Request a substantive response to disputed inputs. If the landlord claims a larger area or additional points, identify the missing evidence. Keep the proposal and proof of sending. Negotiations do not automatically suspend a statutory deadline.
8. Keep defects and service charges distinct
A home can exceed its points-based maximum and also have a serious defect. These are different legal questions with potentially different procedures. A points calculation does not order repairs. Service charges require assessment against agreed services and allowable actual costs.
Create separate file sections. Identify which amount or defect is addressed where, and obtain advice before overlapping applications. Rejection of one issue should not be mistaken for a decision on every problem with the home.
9. Apply the outcome carefully
Retain the decision or written agreement and precise effective date. Reconcile old and new rent with advances and any huurtoeslag. Recovery of overpaid rent is a separate step; the Huurcommissie does not collect it for you. If repayment is withheld, obtain advice and keep a monthly account. Do not change payments solely on your own calculation.
- Basic rent and additional payments separated
- Accommodation type and assessment date chosen
- Plan, energy label and WOZ inputs checked
- Differences from landlord’s points identified
- Procedure, proposal and deadline established
Which price check fits?
| Question | Relevant information | Route to investigate |
|---|---|---|
| Initial rent excessive | Initial condition and first basic rent | Initial rent assessment |
| Current basic rent excessive | Points and applicable regime | Rent reduction proposal |
| One undivided price | Original price agreement | All-in separation |
| Excessive charges account | Invoices, advances and allocation | Service charge procedure |
Example: one monthly total, two separate checks
Yassin pays €1,100 monthly: €950 basic rent and €150 advance. In this illustrative example, the points check gives a maximum basic rent of €910. These figures are examples only.
He compares €950 with €910 rather than the total €1,100 with €910, then checks the agreement date, sector and procedure. The €150 advance is assessed separately through service charge accounting. The calculation does not establish a right to withhold the entire €190 difference between the total payment and points maximum.

Is an online points check binding?
No. It supports an initial assessment. In proceedings, the Huurcommissie may inspect and value the home itself. Legal consequences follow from the applicable procedure and decision.
Can a landlord charge more because others do?
Advertisements do not establish the statutory maximum within a regulated system. First determine which protection applies to your agreement. Market comparison does not replace contract and points checks.
Does an incorrect energy label immediately change rent?
Not automatically. Establish the available procedure and which data or corrections it assesses. Keep the label and supporting evidence; a suspicion is not yet an adjusted rent.
Can repayment be agreed without proceedings?
Yes, a supported written settlement can specify the amount, period, payment date and future rent. Without agreement, seek advice about the available procedure and recovery claim.
