Objecting to service charges: support each disputed item

5 minute read

Human legal and language review remains pending.

A useful service charge objection states the disputed amount, reason and requested correction. Saying the bill is far too expensive gives the landlord or authority little to assess. Begin with an organised costs schedule and then choose the procedure matching the agreement, accounting year and outcome needed. Distinguish a request for missing evidence from a substantive objection, while keeping both steps documented.

Identify exactly what is disputed

List the charges and mark only contested components. Arithmetic, an undelivered service and an incorrect allocation each need different evidence. Also identify unknown information. A missing invoice need not be replaced by a guess. Use the annual account guide and calculation schedule for the initial check, preserving accepted and uncertain amounts separately.

Request a missing account demonstrably

If no account has arrived, request it in writing with the year and address. Retain the sent message. The Huurcommissie explains prior requests. Phone contact can help without proving precisely what was sought. Once an account arrives, assess it substantively: the earlier information request does not automatically constitute an objection to every new item.

Request focused document inspection

Identify missing cleaning invoices, allocation, meter readings or furniture calculations. This is more focused than asking for all administration. Link each request to its disputed amount and check the agreed service. Supplier expenditure alone does not prove correct allocation to your occupation. Record both documents received and questions that remain unanswered so a later reader can follow the evidence gap.

Write an objection per item

State the item, amount, reason and remedy in sequence. Attach the relevant payment or contract evidence. For unclear arithmetic, request a reproducible recalculation rather than choosing an arbitrary lower sum. Keep frustration about management separate from the factual basis. A neutral, specific explanation allows any reader to identify the question requiring decision.

Allow the relevant response opportunity

The usual Huurcommissie policy describes three weeks for response after preliminary contact. Check current conditions before filing and retain the response or evidence of silence. If final filing is imminent, an exception to waiting may matter: obtain prompt advice. A model letter’s standard response period should not cause a statutory application deadline to be missed.

Check sector and agreement date

The Wet betaalbare huur changed jurisdiction. For agreements from 1 July 2024, the Huurcommissie can assess service charge disputes across sectors. Older liberalised agreements have different possibilities, including advice by written consent. An earlier corrected rent may also affect classification. Retain the original agreement and decisions rather than relying solely on current monthly rent.

Specify the scope of the application

The Huurcommissie assesses disputed components included in the request. Match the requested items to correspondence and attach the correct account. An electricity objection does not automatically include an unmentioned furniture charge. Identify tax or care payments separately: not everything collected with rent falls under identical powers. Consult Huurcommissie or court before assuming one application can resolve every payment.

Manage payments alongside the dispute

An objection does not generally authorise stopping every advance. Obtain advice about the actual amount and non-payment consequences. Keep a payment schedule and clarify allocation where necessary, avoiding one unexplained balance combining rent, advances and old contested costs. If collection correspondence arrives, add it to the file and respond to that specific new step.

Check the decision or agreed correction

Identify the accounting year, amounts and treatment of sums already paid. Establishing liability differs from receiving repayment. Retain the revised account and agree a payment date. If you disagree with the outcome, seek immediate advice about the available next step and deadline. The Rechtspraak explains tenancy proceedings; do not assume an unlimited opportunity to restart later.

Example: turning dissatisfaction into a defined objection

A room tenant receives cleaning and electricity charges, cannot recognise the consumption and lacks an invoice. They request the invoice and readings. The documents include a period before the tenancy began. The objection then identifies that particular period and requests correction.

The tenant retains cleaning information without declaring it wrong without evidence. A documented, focused question is stronger than blanket disagreement. The final amount still depends on actual supply and the appropriate allocation method.

Frequently asked questions

Do I need a lawyer for the Huurcommissie?

A lawyer is not routinely mandatory. Assistance can help with sector classification, transitional rules or an approaching deadline. Prepare the complete agreement and account for focused advice.

Can different calendar years be combined into one amount?

Keep every year separately verifiable because filing dates can differ. Ask which forms are required. A total collection balance does not replace individual annual accounts. For the described annual service-charge procedure, Huurcommissie policy sets the final application deadline at two and a half years after the accounting year. For calendar year 2024, this is 30 June 2027. Also check jurisdiction and the required prior letter; discussions do not automatically extend this deadline. Source.

What if the landlord corrects only part?

Confirm the correction and unresolved items. Keep old and new accounts. A partial solution reduces the dispute without automatically accepting every remaining item.

Is reporting to the municipality sufficient?

Reporting may trigger enforcement of landlord rules. Establishing personal payment liability or obtaining repayment can require another procedure. Preserve your dispute deadlines while municipal investigation continues.
