Disputed temporary tenancy and a demand to leave: defend two layers
6 minute read
Human legal and language review remains pending.
If a landlord relies on an end date while you dispute temporary tenancy, prepare more than a general reference to indefinite agreements since 2024. Examine both whether the statutory exception fitted when the agreement was made and what the parties actually agreed about termination. These questions can matter independently. Also provide every alternative allegation: challenging automatic expiry does not itself answer a separate dissolution or eviction ground.

Read the actual ground for departure
Keep the agreement, general conditions, expiry notice and court papers. Does the landlord say the tenancy automatically expired, or give notice on a protected tenancy? Is eviction also sought for breaches? Mark each ground separately. The general temporary contract guide helps identify the form; this assessment concerns the particular demand.
Date agreement, commencement, expiry and messages. Around 1 July 2024, agreement formation can matter; handing over keys is not automatically the same moment. A new copy does not necessarily create a new start either. Request originals and respond by the next formal date while the history is examined.
Request the exact exception and supporting facts
For new agreements, indefinite tenancy is the general rule with specific exceptions. Ask which category is used and which starting circumstances support it. A ticked box or the word student does not independently prove every condition. Place each element of the asserted exception beside the relevant evidence.
For a student argument, gather previous residence and study records and the reason for moving. Another category needs different facts. Do not apply the same checklist indiscriminately to social emergency, renovation accommodation or a special tenancy form. Link the factual reason and applicable regime to the specific contract date.
Evidence the difference between an address and actual circumstances
In Midden-Nederland 2026:3148, the tenant already lived and studied in the municipality and intended to keep studying there. The provisional interpretation did not fit merely originating from another municipality. An address on an enrolment certificate did not alone determine actual circumstances.
Do not treat that decision as an automatic answer for every student. Find your own previous residence period, course, admission records and communications, including unfavourable material. Explain an incorrect address or purpose specifically. A student agreement can also involve a different target-group scheme; a campus agreement is not ordinary study accommodation expiring automatically.
Read termination arrangements as an independent second layer
Even if a statutory exception was possible, what the parties actually agreed remains relevant. Does the duration clause give an end date while termination provisions require ordinary notice and a statutory ground? Read general conditions and the offer’s context too. A temporary heading does not automatically resolve conflicting content.
In Midden-Nederland 2026:7192 the target-group question could remain open. Even assuming it applied, the preliminary contractual interpretation did not permit ending by expiry notification alone, given the agreement’s notice provisions. This does not mean every missing statutory reference has that effect. Have exact wording, expectations and conduct interpreted together for your file.
Assess the expiry message after both layers
A message may be timely yet fail to follow the applicable termination route. Conversely, a defect in one message does not automatically make every other ground impossible. Identify which communication relies on which contractual or statutory route. The temporary expiry guide explains notification once the applicable regime is clear.
Do not supply a notice on the landlord’s behalf yourself or sign a departure declaration merely to confirm receipt. Make your position recognisable without an untested guarantee of staying forever. Negotiated proposals can have independent effects. Distinguish practical investigation arrangements from agreeing to end the tenancy.
Do not overlook an alternative breach ground
A landlord may allege arrears, prohibited use or conduct alongside expiry. Prepare a separate response with balances, arrangements and facts. The October case assessed the alternative route independently for urgency and weight. Failure of automatic expiry did not decide other allegations without examination.
Continue taking ongoing duties seriously. A dispute over duration does not justify withholding rent or prove every use permitted. Record payments and completed corrections. Have accepted and contested matters identified. General anger about a temporary form should not distract from another specific claim requiring its own answer.
Give legal assistance a focused assignment
Ask legal assistance for three questions: category at formation, interpretation of termination, and response to additional requests. State what decision you want clarified and whether enforcement is imminent. Another case’s provisional ruling does not predict your ordinary or interim proceedings.
Send more than the end-date page: include the offer, previous tenancy, conditions, starting facts and every message. Mention any scheduled hearing. Agree who files and monitors new correspondence. An earlier objection email does not replace responding to later court papers or an amended claim.
Clarify continuation and financial arrangements
If you remain, make clear which payment is made and why. Calling it an occupation fee does not itself establish expiry. The October judgment distinguished existing rent from the occupation fee claimed. Have the calculation and legal basis checked without stopping payment because of one label.
Use the dossier tool for the two-layer map and outstanding dates. If parties voluntarily make a new arrangement, specify duration, rights, money and proceedings. This preparation supports assessment of this particular ending; it does not invalidate your entire agreement or provide general exemption from payment and use obligations.

Two layers and one separate additional question
| Question | Your evidence | Insufficient alone |
|---|---|---|
| Was this form permitted? | Starting facts and statutory category | Title or current student certificate |
| What was agreed? | Duration and termination with conditions | End date only |
| Is another ground alleged? | Specific response to breaches | Disputing temporary status only |
Fictional example: a student label and a notice clause
A tenant receives an expiry message for a new contract labelled student. He already lived locally at formation. His adviser gathers starting records and separately reads the complete notice arrangement chosen by the landlord.
An additional occupation allegation receives its own answer. The example predicts no result: statutory eligibility and contractual interpretation are independent defence questions alongside other claims. A favourable answer to one must not hide the others.

Frequently asked questions
Is every agreement after 1 July 2024 indefinite?
Not automatically: specific exceptions and special forms need separate assessment.
Does an end date establish automatic expiry?
No. Examine the applicable regime, agreements and necessary steps together.
Does an incorrect temporary clause invalidate everything?
Do not conclude that. Effects on duration and other duties require separate assessment.
May I ignore other allegations if temporary status is wrong?
No. Additional grounds or money requests need independent responses.
