Preparing opposition to a tenancy judgment: from objections to evidence
6 minute read
Human legal and language review remains pending.
This preparation begins after it has been established that opposition is the appropriate route against your default judgment and who is monitoring the deadline and enforcement. Use the default judgment guide for that initial assessment. It also contains a first inventory of what you want changed. Here you then develop the substantive case file: which original allegation is incorrect, which document proves that, and which separate defence or claim of your own follows? Without a confirmed route and timely procedural action, a substantive file does not replace bringing opposition.

Develop the substantive evidence task after choosing the route
Bring the initial decision map from the default judgment guide; do not repeat it as general triage. For each disputed point, place the original allegation from the summons alongside your specific response, supporting document and requested procedural decision. Also identify which allegation the landlord already supported with an exhibit. The additional task is a substantiated answer to it, rather than merely listing the operative orders.
For every line, state the change you want, such as a reduced amount or dismissal of a particular request. Merely disagreeing with everything is insufficiently specific. Mark unknown matters, including missing payment specifications. Give the adviser unfavourable facts too. Selecting only your strongest messages can lead to an incorrectly framed defence.
Substantiate differences in the rent account
For a money claim, prepare a month-by-month table showing rent due, payments, dates and references. Match each disputed entry with a bank record or agreement. Separate payments before the original summons from later ones. Identify the receiving account and any former manager. This distinguishes genuine arrears, processing errors and disputed contractual charges.
Keep interest, collection fees and litigation costs separate. Paying basic rent does not prove all additional costs disappear. Nor does a later revised statement automatically explain why the original amount was wrong. Use the arrears guide for the balance, then specify which judicial order the evidence concerns and which correction you seek.
Challenge dissolution with more than a payment record
If dissolution or eviction was awarded, identify the alleged breach and relevant facts. For payment problems these may include duration, developments and recent arrangements. Nuisance or subletting requires different evidence. Respond to the reason stated in the original papers. A general wish to remain in the home does not fully answer that legal ground.
Describe concrete consequences and relevant personal circumstances with proportionate evidence, separately from whether the breach occurred. Later payment may matter without automatically restoring a dissolved tenancy. Ask the adviser to explain why the original claim should be reassessed differently. No fixed number of months or personal circumstance in this guide guarantees a particular result.
Consider your own claim deliberately
Rechtspraak explains that an opposition writ can also contain your own claim, with grounds and evidence. A complaint alone does not automatically obtain repairs or payment from the judge. Discuss whether a counterclaim is appropriate. Defending against the landlord’s demand and bringing your own claim are different procedural actions, potentially with different effects and costs.
Give any independent request its own line: what you seek, from whom, on which facts and with which documents. Include earlier reports and replies. Have the adviser decide whether it belongs here or elsewhere. Wanting to resolve old disputes together does not justify adding everything indiscriminately; unfocused expansion can obscure an urgent issue.
Make exhibits easy to verify
Number documents and cite the relevant number and page for each fact. Keep complete conversations showing date, sender and context, rather than one favourable sentence. Create an index stating what each document is intended to prove. Legible copies are more useful than unordered photographs. Preserve originals safely and do not alter text in evidence files.
Identify possible witnesses and what they personally observed and when. Rechtspraak mentions written witness statements as possible evidence; their weight and further use need assessment. Do not blend your conclusions with a witness’s account. Ask what translation foreign-language documents require. Limit medical and financial material to relevant evidence and discuss secure transfer.
Have the opposition writ drafted for your case
Rechtspraak lists parties, objections to the original claim, evidence and hearing details among the required contents. Statutory requirements apply. Establish who checks the correct opposing party and court and whether ordinary or interim proceedings apply. This requires drafting from your file, rather than merely inserting names into a generic internet form.
Review the substance of the draft: admitted and disputed facts, current figures and requested changes. Do not replace legal drafting solely with automatic translation. Report errors promptly. Even a well-written document can be served incorrectly or late; keep formal and deadline checks visibly assigned alongside substantive review.
Allocate service, filing and enforcement monitoring
Rechtspraak describes service of the opposition writ by a bailiff on the other party, followed by sending the served instrument to court. Assign both steps and their confirmations. A draft, paid advance invoice or lawyer’s intake does not prove these actions happened. Investigate missing completion information immediately.
A judgment enforceable notwithstanding remedies may still be enforced during opposition. Where necessary, assess the separate suspension question and monitor eviction alongside opposition. A lawyer is not compulsory before the subdistrict court, but threatened housing loss and disputed admissibility can make specialist legal assistance important. Instructions do not guarantee success.
Update evidence while continuing procedural compliance
Date and add new payments, settlements or evidence, asking how and when they can still be submitted. Ordinary subdistrict proceedings and interim proceedings differ; do not copy a deadline from another procedure unchecked. Establish who informs the opponent. A document saved in your folder is not automatically a court exhibit.
If you settle, expressly record the consequences for judgment, opposition, enforcement and costs. Continue following procedural directions until disposal is sufficiently confirmed. Ask what actually happened and what remains outstanding. Use the file tool to track responsibilities. It organises preparation but neither institutes opposition nor assesses a legal time limit.
- Complete summons, judgment and service papers
- Matrix for each operative order
- Monthly balance with numbered payment evidence
- Separate examination of dissolution and eviction
- Counterclaim deliberately considered
- Named responsibility for service, filing and enforcement
From complaint to procedural issue
| Order | Targeted evidence | Assessment sought |
|---|---|---|
| Payment | Monthly table and bank records | What is genuinely owed? |
| Dissolution/eviction | Breach, context and later events | Why should this request be assessed differently? |
| Your own claim | Separate grounds, request and exhibits | Is an independent counterclaim needed? |
Fictional example: one payment, two separate orders
A tenant discovers an unprocessed payment. The judgment also dissolves the tenancy and orders eviction. He links the bank record to the monthly entry, then creates a separate dissolution issue with the history of arrears and agreements. The adviser independently checks the remedy deadline and procedural route.
A desired repair is discussed as a possible separate request instead of hidden in a complaint. Enforcement remains monitored meanwhile. This example predicts no reversal: one favourable payment record does not automatically answer every part of the case.

Frequently asked questions
Is explaining my absence sufficient?
No. Have the original claim assessed substantively too. Deadlines, admissibility and the merits each need their own support.
Should I include every old dispute?
Select relevant matters and discuss your own claim separately. Unrelated documents can obscure the actual issue.
Does a draft already institute opposition?
No. Service and filing must follow the applicable procedure. Request confirmation of completed actions.
Does one correct payment eliminate eviction?
Not automatically. Challenge each order specifically and assess threatened enforcement separately.
