Temporary again after renewal? Reconstruct the contract chain
5 minute read
Human legal and language review remains pending.
A new signature, housemate or rent does not automatically restart temporary tenancy. When the same accommodation continues, the agreement’s history matters. Make more than a list of end dates: trace who rented what, from when and through which document. This allows assessment of whether a later temporary label fits rights already established, without confusing every administrative update with a new tenancy.

Start with the first agreement for this accommodation
Collect the original contract, attachments, offers and later amendments. Identify the actual accommodation: individual room, entire property or joint tenancy. The same address is not always the same rented object, but a changed filename does not change it either. Compare description, access and rights of use.
The temporary contract guide helps identify the original regime. Formation, commencement and end dates are different facts. Include earlier continuation even without a new document. Ask the landlord or agent for missing versions and keep their explanation of what was intended.
Trace each person, not only the property
Record each occupant’s arrival, departure, contractual role and signed documents. Who stayed when another left? Who joined later? Were you named tenant or resident only? Joint occupation raises different questions from separate room agreements. The co-tenancy guide helps identify roles.
Compare changes without assuming a new group number erases earlier rights. Ask what legal act is intended: amendment, joining, transfer or genuinely new agreement. Keep messages confirming existing tenancy too. Calling a document an addendum does not determine its effect alone; content and previous history matter.
Examine consecutive temporary arrangements specifically
Government information explains that extending the usual temporary tenancy can lead to indefinite tenancy. First check the applicable form and transitional rules. A new year on another form does not independently postpone protection again. An arrangement made before the initial period expires can matter too.
Amsterdam 2026:8912 treated a consecutive new agreement for existing tenants as indefinite continuation, including signing again before expiry. Do not turn that into a rule for every possible letting form. Have the old statutory regime, accommodation, people and continuity examined in your own history.
Assess what changing an occupant did
With group occupation, a new form may be requested whenever somebody leaves. Ask separately about remaining tenants and the incoming person. A transfer does not automatically mean already indefinite duration becomes another two years. Request the legal basis and claimed effects in writing.
In the Amsterdam case, later residents were assessed as joining an already indefinitely continued relationship. Your court may need to examine different facts. That judgment did not generally decide every possibility of contract transfer for residential accommodation. Do not convert that open question into unlimited assurance for every incoming housemate.
Read termination and waivers separately
A form may end the old agreement while offering another. Identify whether that is actually requested and when. Signing an administrative replacement may otherwise carry more consequences than expected. The indefinite tenancy guide gives the basis; have the chain and proposed surrender considered together.
Amsterdam also addressed a provision intended to create automatic ending and another temporary round after occupant changes. It could not remove tenant protection to their disadvantage there. That does not excuse reading a new voluntary termination agreement. Ask which existing position would be surrendered and whether that is truly intended.
Separate duration from price and debts
Compare basic rent, advances, deposit and liability across versions. Indefinite duration does not itself establish whether a rent change is valid. Conversely, a different price does not automatically create a wholly new tenancy with freely chosen temporary duration. Ask for each change’s basis and date.
In joint tenancy the internal division may change while the total landlord-facing obligation continues. Document departure financially as well. Do not stop payment unilaterally because duration is disputed. Keep balances and records so the duration question does not conceal an independent payment problem.
Answer an expiry message with the complete chain
If departure is demanded, send more than the latest form for assessment. Include the chain table and relevant versions. An expiry notice can be timely while assuming temporary duration that previously changed. That needs a specific answer, not merely saying every renewal is indefinite.
Ask legal assistance what position and decision require confirmation. Read procedural papers for their own dates. The Amsterdam outcome does not predict every group dispute. Identify passages supporting your view and missing records, enabling assessment of risk and the appropriate next step.
Confirm continuation without unnecessarily restarting
If continuation is acknowledged, obtain clear confirmation of duration, tenants and existing terms. Correcting administration should not silently add a new starting rent, debt admission or waiver. Describe joining and release of a departing person accurately rather than simply signing another temporary form.
Use the dossier tool for the chain and absent versions. Preparation distinguishes continuation, amendment and departure; it cannot guarantee every form has the same effect. Keep the objective clear: establish the current position assessably and reduce future uncertainty without merely accepting another temporary title.
- Original contract and every version
- Accommodation per period
- Chain for each arrival and departure
- Ending and waiver provisions separately read
- Price, deposit and liability separated
- Current response and continuation confirmation
Three changes that are not equivalent
| Change | What to examine | Not automatic |
|---|---|---|
| New period | Regime and contract chain | Another temporary tenancy |
| New occupant | Joining and remaining tenants | Erasure of existing rights |
| New amount | Price basis and terms | New tenancy with free duration |
Fictional example: a third form for the same group
Two residents stay while a third leaves. The agent sends another two-year contract. A tenant collects the first and second versions and amendments and dates each person’s joining.
The adviser first checks whether duration became indefinite earlier, then incoming occupation and price. The example predicts no result; the third form alone gives an incomplete picture of the same accommodation.

Frequently asked questions
Is every second document a renewal?
Not merely by counting. Examine form, accommodation, people and content.
Does a housemate change restart temporary tenancy?
Not automatically. Remaining and incoming positions need separate assessment.
May I ignore every price change with indefinite tenancy?
No. Duration and price are different questions; assess the particular change.
Should I keep only the latest contract?
No. Earlier documents may determine rights already established.
