Default judgment in a tenancy case: what should you do now?
8 minute read
Human legal and language review remains pending.
If you did not respond in a Dutch tenancy case and a judgment has now arrived, immediately have someone assess whether it is genuinely a default judgment, which remedy remains available and whether enforcement is imminent. A complaint to the landlord is not a writ of opposition. Keep both the judgment and its delivery documents: the judgment date does not automatically start your opposition period. Report an eviction date immediately, even if your file is incomplete.

Has a judgment been given, or has default merely been recorded?
Rechtspraak distinguishes responding late before and after judgment. Until a final judgment has been given, entering an appearance may still be possible, known as curing default. After a default judgment, a different next step must be examined. Ask the court for the procedural status if you do not know it, quoting the case number. Do not wait for another copy before reporting urgency. Notice that judgment will follow is different from the judgment itself.
Compare every page with the original tenancy summons. Record who was ordered to do what and whether the decision concerns payment, termination, eviction or several matters. Keep any correcting judgment too. A staff member quoting a balance by telephone cannot replace the full operative order. List missing documents and request them specifically, without assuming that a missing page invalidates the decision.
Check the procedural history, not just the heading
Tell your adviser whether you or a representative previously responded, requested an extension or attended a hearing. Send dispatch records and court messages. A judgment delivered without your attendance is not necessarily a default judgment. Where there are several defendants, the legal status of the decision also needs examination. The real procedural history determines the appropriate route; do not choose a remedy because a generic internet letter says objection.
If someone already represented you, immediately establish who received which documents and whether their instructions continue. Record agreements and responses objectively, preserving original correspondence. Differences between your recollection and the court record need investigation. Lack of personal contact with the judge does not prove that nobody appeared on your behalf. This check prevents losing time on a remedy that does not fit the decision.
Keep three separate timelines
Record the judgment date, every delivery or enforcement event and the announced enforcement date separately. Rechtspraak usually mentions four weeks for opposition, with several possible starting events; eight weeks may apply in certain situations involving residence abroad. It is therefore not automatically four weeks from the date printed on the judgment. Have both start and end assessed. Translation or waiting for a lawyer does not automatically stop time running. Nationality and this article’s language do not create a longer period.
Keep the bailiff’s instrument, envelopes, emails and earlier responses concerning the judgment. Note how you received it and what you did afterwards. The Dutch text of Article 143 refers, among other things, to personal service, an act necessarily demonstrating awareness and, outside those situations, enforcement. Do not assess these legal concepts from one screenshot. Even if a document was only left in your letterbox, do not assume that every deadline remains open indefinitely.
Read payment, tenancy termination and eviction separately
Make one line for each order in the operative part. What amounts and costs were awarded? Was the tenancy dissolved? What specified period applies to leaving the property? Record the exact wording and conditions. A lower current rent balance does not automatically cancel the other orders. The rent arrears guide helps organise payments; their legal effect on this judgment needs separate assessment.
Also check for a declaration of enforceability notwithstanding a remedy, called uitvoerbaar bij voorraad. Article 145 distinguishes the situations: timely opposition in the proper form generally suspends enforcement, except where the judgment carries that declaration. An intention to oppose or a request for advice is not properly instituted opposition. Ask what specifically applies in your case. A provisionally enforceable judgment may require separate protection; the suspension guide addresses that question.
A letter is different from formal opposition
For opposition before the subdistrict court, Rechtspraak describes a writ: the bailiff serves it on the other party and the served document must be sent to court. An objection emailed to the landlord does not replace this process. Ask who will draft the document, which bailiff will act and who monitors filing. A lawyer is not generally compulsory before the subdistrict court, but loss of housing and disputed deadlines can make specialist help urgent. To prepare the next step, use preparing opposition (verzet) to a tenancy judgment to organise the formal steps separately from your substantive defence.
Establish whether the original case was ordinary proceedings or interim relief, known as kort geding. Rechtspraak provides a separate method for subdistrict interim proceedings. Do not simply copy ordinary calendar-hearing instructions. Ask which current court directions and procedural documents are required. Registry staff can provide practical information, but do not select your defence. Keep confirmations of completed steps, rather than only the name of someone who promised a return call.
Organise what you want changed
For each order, identify what you consider wrong and which document supports that position. A payment record might reveal an incorrect balance entry; an earlier response may illuminate the procedural history. Keep procedural and substantive issues separate. Explain what you accept as well. This inventory helps an adviser assess the case without requiring a hurried lengthy accusation unsupported by concrete facts.
Add later payments and agreements with dates, amounts and contacts. An arrangement can matter, but explicitly ask what it means for proceedings and enforcement. Do not sign wording about final settlement before understanding which rights it relinquishes. Communicate relevant health or family circumstances selectively and limit sensitive material to what is needed. The eviction guide helps monitor practical urgency alongside the court file.
Confirm instructions, costs and urgency
Start your request for assistance with the existing judgment, known delivery information and enforcement date. Ask whether the adviser will actually assess the remedy deadline and who will act. An intake appointment alone does not mean your case is being handled. Discuss fees, possible litigation costs and any subsidised legal assistance using the legal help guide. Keep uncertainty about missing documents explicit in the instructions.
Agree a concrete feedback time and an emergency contact if enforcement approaches. Arrange language or scanning assistance if needed, while sharing unaltered original documents. Use the file tool as an inventory, not a legal deadline calculator. No checklist can determine without assessment whether opposition is admissible or whether it will change the original result.
Monitor proceedings and housing safety together
Until an actual decision or sufficiently confirmed arrangement exists, keep checking enforcement. If eviction is announced, discuss municipal support and practical accommodation alongside legal assistance. Ask a landlord promising delay to confirm the correct date and conditions in writing, and inquire about instructions to the bailiff. Keep a telephone note, but do not present an unconfirmed promise as court protection.
Keep new messages in the same file and have changes assessed immediately. Specify what remains outstanding: obtaining procedural status, assessing time limits, taking formal action or monitoring enforcement. Successfully initiating proceedings does not guarantee victory in the tenancy dispute. This initial triage ensures that the appropriate person sees the correct documents in time, so a possible next step is not lost in confused correspondence.
- Complete judgment and original summons
- Service papers, envelopes and receipt information
- All earlier procedural responses and representatives
- Separate record of payments and orders
- Latest enforcement date at the top of the request
- Confirmed instructions for deadline assessment and urgent action
Three separate questions
| Question | Documents needed | Action to check |
|---|---|---|
| Is this genuinely default? | Judgment and procedural history | Have the appropriate remedy identified |
| Is a time limit running? | Service, receipt and earlier responses | Have its beginning and end professionally assessed |
| Is enforcement imminent? | Operative order and latest bailiff message | Examine suspensive effect or separate protection |
Fictional example: an old judgment and a new eviction notice
A tenant finds a bailiff’s notice stating an eviction date. The attached judgment is older, so she assumes every possibility has expired. Her adviser requests the full decision, service instrument and earlier messages, and investigates whether anyone appeared for her. The date printed on the judgment is not used as the sole test.
At the same time, payment does not simply eliminate enforcement: the operative order also provides for eviction and provisional enforceability. The adviser separately assesses remedies and enforcement protection, recording who monitors urgency. This invented example predicts neither admissibility nor preservation of the home; it shows why three different questions each need evidence and their own answer.

Frequently asked questions
Do I always have four weeks from judgment?
No. The period can start at different events and a different duration sometimes applies. Have service documents and procedural history assessed immediately; do not calculate solely from the judgment date.
Can I oppose by emailing the landlord?
That email does not replace the formal writ of opposition. Establish who handles service and filing and which rules apply to your proceedings.
Is it automatically default because I missed the hearing?
No. Earlier procedural steps and representation may matter. Have the real procedural history and legal status checked.
Does calling a lawyer stop eviction?
No. Asking for help is not suspension. Proper, timely opposition has only the applicable statutory effects; provisional enforceability may require separate protection.
