Human legal and language review remains pending.

Legal expenses insurance does not mean that every lawyer you choose will be paid from the first tenancy complaint. First examine coverage and the specific procedural stage, then make a reasoned request for the lawyer of your choice and agree costs. A statutory right of choice exists for judicial or administrative proceedings and where there is a conflict of interests. For preparatory work, obtain a separate assessment of the applicable legal basis, stage and policy arrangements. An insurance request meanwhile protects no court deadline. This guide helps coordinate choice and funding; it does not automatically impose an instruction on an insurer or lawyer.

First check which policy covers this tenancy dispute

Collect the policy schedule, applicable terms and amendments. Note who is insured, which housing module applies and when the first relevant events occurred. Ask whether the matter concerns advice, a defence or your own claim about defects or eviction, for example. Confirmation of receipt is not yet a substantive coverage decision. Premium payment or the general description home insurance does not answer that question either.

Request a written position identifying the policy clauses relied upon. Are there questions about a waiting period, when the dispute arose, the insured interest or an exclusion? Describe the real timeline rather than reporting an old dispute as new. The general legal assistance guide discusses other forms of help. Here the issue is specifically an existing legal expenses policy; subsidised legal aid or a private instruction is a separate funding route.

Identify the proceedings and distinguish choice from compulsory representation

Article 4:67 Wft provides for free choice of a lawyer or another legally qualified expert for judicial or administrative proceedings and where there is a conflict of interests. In Sneller/DAS, the European Court and subsequently the Dutch Supreme Court clarified that, where relevant proceedings are involved, choice cannot depend solely on the insurer preferring to outsource. Compulsory legal representation is not the decisive condition either.

A lawyer is not mandatory in a tenancy case before the subdistrict court. That is therefore no independent reason to reject every choice request. Include the summons or concrete procedural documents. For a Huurcommissie case, separately ask how that procedure is classified for the policy and statutory right of choice. The word committee, an initial objection letter or a report to the municipality does not itself establish the same legal classification. The route guide helps distinguish the bodies involved.

Request a concrete legal assessment for the preparatory stage

A letter about overdue maintenance, advice or negotiations to avoid proceedings does not automatically guarantee your own lawyer at the insurer’s expense. Ask what stage has actually been reached: merely discussions, a specifically prepared court step or a particular statutory stage. Explain the work you want performed and why it belongs to the identified proceedings. Merely saying a dispute might eventually reach court leaves the boundary question unanswered.

The ’s-Hertogenbosch Court of Appeal referred preliminary questions about the preparatory stage on 25 November 2025; the Advocate General’s opinion in case 25/04605 followed on 26 June 2026. Those sources describe the questions and advice as of their own dates. The opinion is not a judgment. This article therefore derives no current general extension or exclusion of choice for all preparatory work from them. Have the applicable legal basis and case law assessed for a concrete request; do not base unlimited reimbursement solely on a news report, opinion or general name of a procedural stage.

Make a defined choice request before uncertain costs accumulate

State the policy and claim numbers, tenancy problem, procedural stage, preferred lawyer and reasons for the request. Attach relevant documents and a limited cost estimate. Request a reasoned response on coverage, free choice, reimbursable work and when work may start. Identify urgency using the actual date. Coordinate whether the insurer issues the external instruction or which other formal route the terms require.

That coordination does not permit an existing statutory right of choice to depend solely on the insurer’s outsourcing preference. Conversely, giving a lawyer a broad instruction yourself in advance does not guarantee later reimbursement. Clarify with the lawyer whether the initial task is only an introduction, coverage assessment or actual representation. Explicitly ask who pays if the insurer disputes all or part of the costs.

Make the entire cost agreement visible, not just the hourly rate

Ask which external cost ceiling, personal contribution and rate arrangements apply to this file. Have VAT, court fees, bailiff, expert and any opponent’s costs identified as inside or outside the budget. Free choice does not automatically mean unlimited reimbursement. Cost restrictions may not make the right effectively meaningless; whether a particular restriction is permissible requires assessment of the agreement and circumstances, not a universal figure from an example.

Have the lawyer confirm an estimate per stage and when you will be warned of budget overruns. Cover for a first-instance defence does not automatically include a counterclaim, appeal or later enforcement. Agree who requests an extension of authority and when you may receive a bill yourself. The insurer’s coverage promise and your payment obligation towards the lawyer are separate relationships; read both before further work proceeds.

Distinguish conflicts of interests, dissatisfaction and the dispute procedure

A legally relevant conflict of interests is not the same as preferring another case handler. Describe precisely which interests conflict and ask how the provider investigates and resolves this. If dissatisfied about accessibility or quality, provide the messages, missed actions and handler’s response. A general complaint that the case is complicated does not automatically prove an external lawyer must immediately be engaged under the policy.

For substantive disagreement about prospects or approach, ask about the applicable dispute-resolution arrangement and its conditions. That assessment is not automatically an instruction for the same lawyer subsequently to take over the whole tenancy case. Kifid decision 2026-0531 distinguishes a concrete disagreement about approach from merely insisting on a preferred lawyer. This individual binding opinion does not determine the statutory scope of free choice for every insured person. Keep a record of the question actually put to the assessor.

Protect the tenancy case while insurance is being discussed

Place every court date, response date and possible enforcement date alongside the insurance request. Ask who prepares and files the defence until the external instruction is actually confirmed. Ending internal handling and starting with your own lawyer must not leave an unclear gap. An acknowledgement email, cost request or complaint does not automatically amount to accepted representation. Use the case-file tool to identify missing documents and responsible people.

If eviction threatens, urgency must still be assessed while coverage is discussed. Separately agree necessary deadline-protection measures and their potential costs. An extension must be requested and confirmed through the proper procedure; negotiating with an insurer does not grant one. Applications to several firms likewise do not establish that someone is already taking the procedural step. Confirm specific responsibility at each handover.

Answer a refusal on the correct grounds

If refused, ask which element is rejected: the dispute is outside cover, choice is said not yet to apply, the chosen work falls outside the instruction or only certain costs are disputed. Address that ground using the policy, procedural document and request. Start the internal complaints process where necessary. Access to Kifid depends, among other matters, on membership, jurisdiction and applicable rules; court proceedings require a separate assessment. A complaint does not stop the original tenancy case.

Keep one overview of positions, budget, instruction and next action. The tenancy route tool organises the assistance question but does not assess insurance cover. The tenancy disputes and assistance cluster contains related procedural routes. If disagreement persists, obtain expert advice on the appropriate choice, complaint or private funding. That assessment does not promise full retrospective reimbursement of costs incurred without coordination.

  • Collect policy, terms and the origins of the tenancy dispute.
  • Identify coverage, procedural stage and statutory choice basis separately.
  • Send a choice request naming the lawyer, work, estimate and urgent date.
  • Agree the budget, personal costs, VAT and costs per procedural stage in writing.
  • Confirm internal handling, handover and procedural responsibility.
  • Assess the reasoned refusal and suitable complaint or dispute route.

Three questions about choosing your own lawyer

SubjectConcrete questionNot automatically equivalent

ChoiceWhich proceedings or conflict of interests support the request?A mandatory lawyer or every initial negotiation
Costs and instructionWho instructs, for which work and budget?Unlimited reimbursement of every bill
In practice

Fictional example: a summons and a chosen tenancy lawyer

A tenant has a housing module and receives a summons seeking termination and eviction. The internal legal adviser says a lawyer is not mandatory and wants to handle the case. The tenant requests a written assessment of choice for the specific subdistrict proceedings, identifies the date and encloses an estimate from the preferred lawyer. He separates the grounds for refusal from the question of which external costs the policy covers.

Meanwhile, the parties confirm who will file the defence. The lawyer initially receives a defined instruction and records what happens if reimbursement is refused. Earlier advice hours or a later appeal are not assumed to fall automatically within the same approval. The example predicts no litigation outcome or full reimbursement; it shows why mandatory representation, choice, coverage and payment arrangements require separate coordination.

Frequently asked questions

Do I lack free choice because a lawyer is not mandatory before the subdistrict court?

That does not follow. Sneller/DAS and the Supreme Court distinguish choice from compulsory representation. Have coverage, the specific procedure and costs assessed; the absence of mandatory representation is no complete independent answer.

Can I always have my own lawyer paid from the first letter to the landlord?

The existence of insurance alone does not establish that. Request a reasoned assessment of the specific stage, work, policy and applicable statutory basis. This guide gives neither a general guarantee nor a general exclusion for all preparatory work; an Advocate General’s opinion is not a final judgment.

May the insurer make every choice request depend on its wish to outsource?

Not where this undermines an existing statutory right of choice. Coverage, the specific instruction and costs must nevertheless be coordinated. Ask on which separate ground anything is refused.

Is the tenancy case postponed while I complain about my insurer?

Not automatically. Have the necessary procedural action, any extension request and responsible person expressly confirmed. An insurance complaint or cost request does not replace a defence or legal remedy.
