Loss caused by a rental defect: from repair to a substantiated claim

Human legal and language review remains pending.

A leak may have been repaired while your furniture, additional expenses and other consequences remain unresolved. Who must repair the defect is a different question from who must pay for your loss. A temporary rent reduction is not an automatic compensation scheme either. Prepare a separate file recording the defect, the basis of liability, the connection with each item of your own loss and the amount still outstanding. This guide helps you prepare those four steps when the landlord disputes all or part of the consequential loss.

In this article
  1. Separate the outstanding compensation question from maintenance
  2. Record the defect and the history of knowledge
  3. Substantiate why this landlord is liable
  4. Prepare a verifiable loss record for each damaged item
  5. Separate emergency expenses from an independent reimbursement promise
  6. Make insurance handling and your own claim traceable
  7. Send a targeted claim rather than an undivided total
  8. Match the next step to what remains disputed

Separate the outstanding compensation question from maintenance

Write down what is still required: removing the cause, restoring finishes, temporarily reducing the rent or compensating your own loss. The defects guide explains reporting and maintenance. Here the issue is the separate monetary claim. A job sheet marked resolved does not automatically mean that all earlier costs have been paid or accepted.

The Huurcommissie explains that it does not rule on compensation for damage to personal belongings or the home. A court can decide disputed liability and compensation. A decision on rent reduction therefore does not automatically answer the questions about a sofa, drying costs or another individual item. Coordinate related proceedings beforehand.

Record the defect and the history of knowledge

Note when the problem first existed, when you discovered it and when the landlord knew about it. Keep the original report, responses, earlier repairs and technical conclusions. A defect present when the agreement was concluded and one arising later can raise different compensation questions. State what is known and what still requires investigation.

For a defect present at commencement, actual or imputed knowledge, or a statement that the defect was absent, may matter. For a later defect, attribution must be examined among other matters. A maintenance obligation does not itself answer that separate liability question. Give your adviser the entire chronology rather than only a final photograph of the damage.

Substantiate why this landlord is liable

Connect the claim to concrete facts: what error, omission or other basis for attribution is alleged? Did a known problem persist despite repeated reports? Was an appropriate repair recommended but not carried out? Or was this a sudden incident with a different cause and response? Seek an assessment of the legal basis and evidence, rather than a general reference to bad luck.

In Midden-Nederland 2024:5513, the continuing leak was attributable following repeated reports and an insufficiently serious response. In Noord-Holland 2026:7382, the particular facts did not establish attribution of the leak. The contrast illustrates why cause, knowledge and conduct matter. It is not a general rule that every storm excludes liability or every old maintenance message proves it.

Prepare a verifiable loss record for each damaged item

Put the description, owner, previous condition, age, damage, date and amount claimed on one line. Attach photographs, purchase information, a repair estimate and relevant correspondence. Explain why the defect caused this loss. Not every invoice from the same month concerns the same incident; a new purchase does not by itself establish the value of an older lost item either.

Keep damaged belongings for as long as it is safe and reasonable, and ask the insurer or expert what documentation is required before disposal. Safety comes first for unsafe or unhygienic items, but document the situation and reason for disposal appropriately. In the Noord-Holland case, assessment was also impeded by missing images and goods discarded before the offered inspection.

Separate emergency expenses from an independent reimbursement promise

For dryers, temporary measures or accommodation, necessity, duration and reasonableness may be disputed. Record who commissioned the measure, which problem it addressed and when it could stop. An appliance still running does not by itself prove that the same defect continues to necessitate the expense. Keep instructions, meter information and itemised records.

Sometimes there is a concrete payment agreement separate from liability. Record its amount, unit, period, conditions and amounts paid. Noord-Holland 2026:7382 distinguished an earlier dryer reimbursement from costs claimed again later. The judgment establishes no general daily rate: the content and performance of the particular agreement and the necessity of the later period require examination.

Make insurance handling and your own claim traceable

Report the loss to your insurer where appropriate and keep the coverage response, expert report, excess and payments. Ask which part has actually been reimbursed and what further handling is ongoing. An insurer’s rejection does not automatically decide that the landlord owes nothing; insurance and liability have their own conditions.

Do not claim the same loss again without explanation if payment has already been received for it. Prepare a gross overview, reimbursements received and the remaining personal amount. Ask which party will handle any recovery issue. Do not add medical or income loss as an established consequence of mould without an appropriate basis and substantiation; those factual and legal connections require separate expertise.

Send a targeted claim rather than an undivided total

Identify the defect, the alleged basis of liability, every loss item and its connection to the incident. Refer to the correct attachment and state remaining uncertainties honestly. Ask whether the landlord disputes the basis, cause or amount, and offer an appropriate inspection. An inventory containing replacement prices alone often leaves precisely those distinctions unexplained.

Disclose new facts and unfavourable documents. An invoice concerning another room or person needs explanation rather than simply disappearing into the total. The Noord-Holland judgment shows how unsuitable documentation can undermine credibility. Acceptance of a repair instruction likewise does not necessarily acknowledge all your consequential loss.

Match the next step to what remains disputed

Ask legal assistance whether a settlement, a concrete payment or first a liability ruling is appropriate. Midden-Nederland 2024:5513 established liability but left the existence, extent and recoverability of loss to separate damages-assessment proceedings. A favourable liability decision therefore does not automatically establish a final amount already payable.

Use the case-file tool for the four-column record and outstanding actions. Read final-release wording and its interaction with renovation agreements carefully. Do not stop paying rent on your own initiative to collect a disputed claim. This preparation makes a genuine loss question assessable without promising compensation for every inconvenience or all new purchases.

  • Repair, rent reduction and damages separated
  • Defect and knowledge placed on a timeline
  • Liability basis supported by concrete facts
  • Loss recorded by item or cost period
  • Insurance and promises shown separately
  • Net claim and appropriate next step

Fictional example: leak repaired, dryer and sofa still disputed

A tenant reports a recurring leak. After the repair, he requests payment for a sofa and drying costs. He keeps the repair history, photographs of the sofa before disposal and written dryer instructions. He lists costs after the agreed stopping date separately as an unresolved question.

The adviser separates liability, causation, amount and any specific cost agreement. An insurance payment is visibly deducted or separately explained. The example predicts no compensation: repairing the leak and paying every consequential item require different assessments.

Frequently asked questions

Does a repair obligation automatically entitle me to all damages?

No. The liability basis, causal connection and extent of loss require separate substantiation.

Can the Huurcommissie compensate for my furniture?

No. It explains that compensation falls outside its decision-making powers; a disputed claim may require a court assessment.

Must I always keep damaged belongings?

Ask about suitable inspection and documentation before disposal, for as long as retention is safe and reasonable. Carefully document any necessary removal.

Does accepted liability already establish a final amount?

Not automatically. The existence, extent and recoverability of concrete loss items may still require assessment.
