Pro deo in case of imminent eviction: arrange help and monitor the date

Human legal and language review remains pending.

In case of imminent eviction, two questions run parallel: what needs to happen in the rental case and how can the assistance be paid for? Do not wait with the first question until the financing is sorted out. An application for a toevoeging does not automatically stop a hearing or announced eviction.

In this article
  1. What document have you received?
  2. What does pro deo mean in this situation?
  3. Need for assistance without a mandatory lawyer
  4. Debt relief and a payment arrangement are a different assignment
  5. Illustrative example: payment and hearing date overlap
  6. Create an emergency card for the helper
  7. Dispute an amount with a verifiable overview
  8. A postponement agreement must be clear

1. What document have you received?

A payment reminder requires a different response than a summons or a judgment that can already be executed. Note the sender, date, title, and next appointment. Gather all pages together, including attachments and information about responding or appearing. The words eviction or last chance in a letter do not by themselves indicate which stage has been reached.

If an eviction date has been announced or there is a hearing in the short term, report this at the first contact with the lawyer or the Juridisch Loket. Ask who will immediately assess the content and possibilities. A general contact request is not a confirmed assignment for an emergency procedure. Also read rent arrears and next steps.

2. What does pro deo mean in this situation?

A lawyer who works with toevoegingen can assess what assistance is needed and submit the application to the Raad. Financial and substantive conditions apply. Even with a low income, a toevoeging does not automatically follow for every action. Ask which activities the application includes: defense, consultation, an urgent request, or another phase.

With a regular toevoeging, a personal contribution may apply and other costs may remain. Ask how the office handles necessary first steps as long as the decision is pending, and what you owe if rejected. The official application explanation helps to divide the tasks.

3. Need for assistance without a mandatory lawyer

At the subdistrict court, a lawyer is generally not required. That does not mean that an eviction case is simple or that you can wait without preparation. The correct response depends, among other things, on the claim, the alleged shortcoming, previous agreements, and the available evidence.

The judiciary explains which procedures and costs in rental disputes may apply. Have it assessed which route applies to your case. A procedure with the Huurcommissie is not a general alternative for defense against an advanced eviction. The route comparison Huurcommissie or court makes that distinction clearer.

4. Debt relief and a payment arrangement are a different assignment

In case of rent arrears, municipal debt relief can be useful alongside legal assistance. Map out income, fixed expenses, payment proofs, and previous proposals. Ask for a feasible arrangement to be assessed; do not promise an amount you cannot pay. Have every agreement and the consequences for the procedure confirmed in writing.

An application for debt relief, a first payment, or a conversation with the landlord does not automatically suspend a hearing or execution. Explicitly ask if and by whom postponement or another measure has been arranged. In case of a disputed arrear, it must also remain clear which amounts you believe are incorrect and why.

5. Illustrative example: payment and hearing date overlap

A tenant receives a summons and then transfers part of the arrears. He thinks the hearing is therefore canceled. For the lawyer meeting, he places the summons, the payment proof, and the landlord's response side by side. His first question is whether the procedure is still ongoing and what response is needed.

Only then can he discuss how the paid amount, any costs, and his defense in the case should be processed. The financing of this assistance also requires assessment. This example does not give an expectation that partial payment prevents eviction; it shows what uncertainty you need to resolve quickly.

6. Create an emergency card for the helper

At the top, put one line with the document, the date something must happen, and the phone number where you can be reached. Add a short timeline and the relevant documents. Refer to payment proofs instead of a long, disorganized message series. Do not send sensitive documents via this worksheet; agree on a secure channel with the helper.

Have it confirmed who takes on the case, who performs a procedural action, and when you will receive feedback. Also discuss the costs of a rental dispute. This way, the financing question gets its own place without the urgent rental question fading from view.

7. Dispute an amount with a verifiable overview

If you believe the arrears are incorrect, list each disputed month and payment separately. Mention the payment date, description, and the amount the landlord claims. Only include existing evidence and keep a proposal for an arrangement separate from your position on the debt. Have a lawyer assess how to present the difference legally.

An appeal for defects does not automatically nullify rent arrears. Therefore, also inquire about the consequences of previously withheld rent and any set-off. Use the file to verify facts; have the legal formulation of a defence assessed.

8. A postponement agreement must be clear

If you are informed by phone that something is temporarily postponed, ask exactly which action is being postponed, until when, and by whom. An agreement on collection costs may mean something different from withdrawing a claim or suspending execution. Keep a written confirmation and send it to the advisor.

If the situation changes, for example due to a new payment or a different execution date, report it immediately. Ask the lawyer if a previous plan still fits. An old cost estimate or general callback promise says nothing definitive about the current process step.

Extra exercise: turn a missing answer into a question

Illustrative exercise: you know an office will call you back, but not whether it has already performed a necessary action for you. Then note the concrete question: have you accepted the assignment and who monitors the date in my letter? Also ask for confirmation for the financing and costs. A completed worksheet alone does not give that assignment.

Practical preparation

Prepare for the conversation

Only fill in short notes. Do not record BSN, children's names, medical information, or other sensitive data. This worksheet helps you organise questions; it does not calculate entitlement to subsidy.

Your notes remain on this page in your browser. This worksheet sends and saves nothing. Download only on a device where you want that; you decide with whom you share the file.

Letter, summons, judgment, or announced execution?

Take the date literally; this worksheet does not calculate a deadline.

Which amounts have been paid and which are disputed?

Who assesses the case and who performs the next action?

Take this to your conversation

  • All pages of the most recent legal document.
  • An overview of advanced and paid amounts.
  • The actual hearing or execution date.
  • The confirmation of who acts in time.

This is general information about Dutch law. The worksheet is not an application, objection, calculation of entitlement to subsidy, or confirmation of an assignment. Check deadlines in your own documents.

Frequently asked questions

Does a pro deo application stop the eviction?

No, not automatically. Have the legal possibilities and deadline monitoring assessed separately.

Can I go to the Huurcommissie to stop an eviction?

The Huurcommissie handles specific rental issues. An eviction claim and any execution require an appropriate judicial route.

Is help mandatory free because it is urgent?

Urgency does not provide a general guarantee of free treatment. Ask about the arrangement, any personal contribution, and other costs.
