Huurcommissie or subdistrict court: where should you start? General information.

Do you want a rent assessment, a statement checked, repairs ordered or a deposit repaid? Tenancy dispute is too general a description. Formulate one specific question first. Then establish which body and form fit that question.

The Huurcommissie considers certain rent, service-charge and defect disputes. Each procedure has specific conditions and forms. You sometimes need to send a proposal, report or objection to the landlord first. Check the route before simply submitting a collection of documents.

A subdistrict court may be needed for an order to repair or a payment dispute. A lawyer is not compulsory in subdistrict proceedings, but advice can still help. Urgent and ordinary procedures differ; do not choose whichever sounds quickest without assessment.

A Huurcommissie outcome is not identical in every case. Conditional advisory procedures may particularly apply to older private-sector contracts. Advice differs from a binding decision. Record the contract date, sector and issue and read the actual effect of the chosen procedure.

Short deadlines may follow a decision for an objection or court proceedings. A complaint or request for explanation does not automatically replace the appropriate legal remedy. Read the decision in full and seek help if challenging it. The guide provides an overview and official references.
